PROTECTION OF THE BUILDINGS:
Field of application:
Under the terms of the law of December
31, 1913 on the historic buildings and of its modifying texts, the lawful
procedures are of two types and concern:
- the buildings whose conservation
presents, from the point of view of the history or art, a public
interest. Those can be classified like historic buildings, entirely or
partly, by the care of the Minister for the Culture and Transport.
- buildings or parts of buildings which,
without justifying a request for immediate classification, are of
interest of history or sufficient art to make desirable safeguarding of
it. Those can be registered on the additional inventory of the historic
buildings by decree of the prefect of area.
Initiative:
The procedure draws its origin either
from an initiative from the minister from the Culture and Communication,
its services, or the prefect of Area, or of a request formulated by the
owner of the building or a third y having interest (local communities,
associations in particular).
The request for a possible application of
the provisions of the law from December 31, 1913 to a building, or left
building, must be accompanied by information on the precise localization
of this building (cadastral reference in particular) and on its history,
as well as few photographs (at least one by frontage). This request is
examined by the permanent delegation of the regional Commission of the
Inheritance and the Sites, which judges if it is necessary to take action
pursuant to it and to constitute a file of complete census.
Mode of constitution of the file: The
file of census is carried out by the in charge ones of documentary studies
of the regional conservation of the historic buildings, if necessary in
collaboration with a specialist in the covered subject. When they are
archaeological vestiges, the file is consisted the regional service of
archaeology.
The file includes/understands:
- a documentary card giving of the
information detailed on the building (legal and administrative
situation, documentary sources, history, standardized description);
- various additional documents necessary
to the knowledge of this building (medical card, cadastral extracts,
plan, sketch...);
- photographs.
Instruction:
Each file is covered opinion of the
instructors territorialement qualified:
- the architect of the buildings of
France,
- the architect as a head of the
historic buildings,
- the conservative of the inheritance in
charge of the inspection of the historic buildings.
The dossier is then submitted, for
examination, at the Regional Commission of the Inheritance and Sites (C.R.P.S.).
Case of inscription on the additional
inventory of the historic buildings:
The decree of inscription is
signed by the prefect of area.
The decision of inscription on the
additional inventory of the historic buildings can be made without the
assent of the owner.
Case of proposal for a classification:
Initially, the
prefect of Area takes a decree of inscription. The file, provided with the
opinion of the owner, is then sent to the ministry for the Culture and the
Communication, for consultation of the higher commission of the historic
buildings. This one can, either to propose the classification, or to
consider sufficient the inscription on the additional inventory. On the
first assumption, and in agreement with the owner, the decree of
classification is signed by the minister. In the event of dissension of
the owner, the classification can be marked only by decree as a Council of
State.
Notification and publication:
All the decrees of protection are
notified by the prefect of the department to the owner, the mayor of the
commune and the departments concerned. They are also published at the
office of the mortgages and the Official Journal.
The authority of
classification:
If the building is threatened of disappearance or imminent
deterioration, the minister can make a decision of authority of
classification which is notified to the owner by the prefect of department.
Consequently, all the effects of the classification apply to the building
considered throughout one one year. This time makes it possible the
administration to continue the normal procedure of protection.

Effects of the classification among the Historic buildings:
Effects on the monument even:
The building classified historic building
cannot be destroyed, moved or be modified, even partly, nor to be the
object of a repair of restoration or without prior agreement of the
Minister for the Culture and Transport.
The private building classified
historic building can be yielded (given, sold, bequeathed...) freely but
the owner must warn the regional manager of the cultural affairs of it.
The classified building pertaining to a community or a publicly-owned
establishment can be alienated only after opinion of the Minister for the
Culture and Transport.
The building classified historic building cannot be
acquired by regulation. One cannot apply legal constraints to him being
able to cause degradation, i.e. primarily the constraints of town planning
(alignment). It cannot be exproprié without the Minister for the Culture
and Transport being consulted. The opening to the public is by no means
obligatory.
Effects on the accesses of the monument:
Any construction,
restoration, destruction carried out in the field of vision of the
building classified historic building (i.e. in general in a perimeter of a
radius of 500 Mr. around the monument) must obtain the agreement of the
departmental architect of the buildings of France.
Effects on the
taxation:
The owner of a building classified historic building profits
from tax deductions on the share with his load of the subsidized work
carried out on the monument (100 %), on the expenses resulting from the
opening of the monument to the visit (100 %), on the other land loads (100
or 50 % according to the opening or not to the visit), as well as
exemption of the transfer taxes on a purely free basis (succession or
donation) with the help of certain engagements and the making of a
convention-type with the State. All specified on this subject can be

Effects of the inscription on
the additional inventory:
Effects on the monument even:
The registered
building not being able to be destroyed, moved or to be modified, even
partly, nor to be the object of restoration or repair without the regional

This work is subjected to the permit building of the mayor of the commune.
The minister will be able to be opposed to this work by initiating the
procedure of classification. The licence to demolish can be granted only

The work authorized on a registered
building is completed by the owner with the assistance of the architect
and the companies of his choice. The work carried out on a registered
building can profit from a financial participation of the State, when it
is about work essential to the conservation of the building.
Effects on
the accesses of the monument:
The effects are the same ones as for the
classification.
Effects on the taxation:
The tax advantages related to the
inscription are identical to those of the classified buildings.

PROTECTION OF THE MOVABLE OBJECTS:
The law
on the historic buildings also applies to the movable objects.
Procedure
of protection:
The file is established by the conservative of antiquities
and objets d'art, then submitted to the departmental commission of the
movable objects which proposes:
that is to say an inscription on the
additional inventory. The decree is taken by the prefect of department,
that is to say a classification among the historic buildings.
The decree
is taken by the minister, after favourable opinion of the higher
Commission of the historic buildings. The private objects can only be
classified and after agreement of their owner.
Effects of the inscription:
The inscription involves, for the owners or affectataires, the obligation,
except in the event of danger, to carry out no transfer of the object
without to have informed the administration of it one month in advance,
and to carry out no transfer, on a purely free or expensive basis,
modification, repair or restoration of the object without to have informed
the administration of it two months in advance.
Effects of the
classification:
The classified object cannot be destroyed, modified, be
repaired or restored without prior agreement of the service of the
historic buildings. It cannot be exported. It is imprescriptible. Freedom
to alienate the classified movable objects pertaining to people public
morals is limited. The ministry for the Culture and the Communication must
be informed, at least fifteen days in advance, of the alienation of the
private objects.

REGIONAL SERVICE OF The INVENTORY:
The general inventory is revealing
cultural identity of the area, through village architecture and of the
urban inheritance, the religious objects or the architecture of the XXe
century.
The regional service of the inventory, with a team of ten people
(researchers, draughtsman, photographer, documentalists, secretary,
manager of data) has the role of counting, of studying and of making known
any work which, by its character historical, artistic, archaeological or
ethnological, constitutes an element of the inheritance.
In 1964, André
Malraux created the general inventory of the monuments and the artistic
richnesses of France. Since, developed a national scientific method
tending to constitute most significant historical, graphic and
photographic documentation ever gathered on the whole of the French
inheritance.
This gradually computerized documentation, is versed on the
national data bases of the Ministry for the Culture and the Communication
(bases Mérimée for architecture; base Palissy for the movable objects,
bases in which figure also the documentation of the historic buildings;
base Mémoire for the phototypes and the graphs).
At the regional level,
the inventory studies in an exhaustive way the patrimonial components of a
defined territory, by canton or commune, or carries out research programs
sets of themes (rural inheritance, religious movable inheritance,
industrial inheritance, enamels...). Documentation thus made up, validated
at the national level, is consultable in the resource centre of the
inheritance, integrated into the C.I.D.
Via this center, the inventory
attempts to develop the tools of documentary information retrieval which
make it possible the public (researchers, developers, teachers, students,
curious...) to reach:
at the national data bases, with the 6 000 files,
the 65 000 photographs and the statements gathered to date in the
Limousin,
the other regional documentary resources held by the other
patrimonial services.
The inventory finally sticks to restore with the
public this accumulated knowledge, as well at the time of exposures as
through publications carried out within the framework of national
collections:
Books of the Inheritance (Architectures of the plate of
Millevaches, Saint-Léonard-of-Noblat, Golden Legend of the Limousin...).
Images of the Inheritance (Country inhabitant of Aix, Canton of Nieul,
Enamels limousins of the Average Age, Brive...). Routes of the Inheritance
(Tulle Theatre, Gimel-the-Cascades, Canopies of Eymoutiers, the
Underground one, Brickyards - Tileries in the High-Limousin, Prefecture of
Limoges...).
Routes of the Inheritance grew rich since 1997 by the
regional collection Trésors by churches (Ambazac, Saint-Victurnien,
Moutier - of Ahun, Rougnat, Naves...) the purpose of which is to inventory,
to present the treasures of the churches of the Limousin and to thus
constitute a true "road of the treasures" of the area.

Reception REGIONAL SERVICE Of the ARCHEOLOGIE:
Since 1991, competences as regards
archaeology within each D.R.A.C are gathered within a regional service of
archaeology. This service is directed by the regional conservative of the
archaeology which is charged to implement the policy of the State as
regards archaeology. The service has the role of studying, of protecting,
of preserving and of promoting the archaeological inheritance in the area.
For this reason, it takes care of the application of the legislation and
the regulation:
on the archaeological excavations and discoveries on the
land use and of the basement (road constructions, careers, mines, layouts,
forest work...)
on the protection of the archaeological vestiges
on the
use of the metal detectors
The regional service of archaeology prepares
the programming of the excavations and prospections by taking account of
the recommendations of the interregional and national scientific
authorities (WAXED: Interregional commission of Archaeological Research
and CNRA: The National Council of Archaeological Research).
He proposes
the subsidies to be granted, thanks to the decentralized appropriations,
the programmed excavations and any measurement as regards protection, of
work of restoration and maintenance of the vestiges put at the day.
He
controls the authorized excavations, directs the excavations carried out
by the State, records the fortuitous discoveries and announces to the
proper authorities the clandestine excavations.
He takes part in the
meetings of programming of maintenance and the restoration work of the
historic buildings. He controls the deposits of excavations and
contributes to the conservation and the study of the archaeological
collections. He takes care of the publication of the results of
excavation.
He coordinates the archaeological activity in the area, in
particular by taking any action of animation and information of the public
as regards archaeology (conferences, conferences, exposures...).
One of the priorities of the service is currently the realization of the
computerized archaeological chart (PATRIARCH application) intended to
improve the taking into account of the inheritance in the projects of
installation and to support the valorization of the vestiges by the
communities (local plans of town planning, protections to the title of the
historic buildings, restoration of the vestiges...).
This protection is
reinforced by the law on the preventive archaeology of January 17, 2001
and the decrees of application of January 16, 2002 concerning the
procedure of application of this law and the creation of the National
Institute of Research in Preventive Archaeology (INRAP). This law was
reformed on August 1, 2003: Ordinary law 2003-707 of 01 August

Reception REGIONAL CONSERVATION OF the
HISTORIC BUILDINGS:
The regional conservation of the historic buildings of
the Limousin, is in charge with protection, the restoration and the
development of the historic buildings. It is made up of a team of about
fifteen people: a regional conservative of the historic buildings, a
conservative of the inheritance, a cell of census cash two in charge of
documentary studies, a cell work and markets made up of an inspector,
technicians and the administrative ones, a secretariat made up of four
people. In the field of the protection, directed and founded partly
towards national and regional sets of themes, it makes the census and a
study of the inheritance likely to be preserved for its historical or
artistic interest.
In parallel, it holds up to date related documentation.
With regard to the restoration, it works out
- on the plans legal,
technical, scientific and financial
- in connection with the architects as
a head of the historic buildings, the architects of the buildings of
France, the conservative of the inheritance in charge of the inspection of
the historic buildings, the conservatives of antiquities and objets d'art
and the general inspection of the historic buildings, the projects of
programs of work on the historic buildings classified and registered, the
objects movable and the organ, on the rural inheritance not protected like
on the accesses from the historic buildings. Within this framework, use
attributions the order, the follow-up and the approval of the studies
preliminary to work on the classified buildings.
The conservation then
fully exerts the financial and technical control of work on the classified
buildings, when the State preserves the quality of building owner. It has
the control of work on the protected inheritance when those are carried
out under the control of work of the owner, that those are subsidized or
not by the ministry for the Culture and the Communication.
Lastly, the
regional conservation of the historic buildings conceives, causes or
supports the implementation of actions of knowledge and valorization of
the inheritance. That can go from the assistance to the projects of
actions of animation turned towards the public (days of the inheritance,
month of the gardens, classes of the inheritance...) to the valorization
of its own interventions (publications on work, exposures...). It
endeavours to improve the reception and the presentation of the historic
buildings belonging at the concerning State direction of architecture and
the inheritance or in connection with the organizations which are
instructed of it, such as the center of the national monuments, in order
to raise this inheritance with the row of instrument of the cultural
action. The conservative of the inheritance in charge of the inspection of
the historic buildings ensures as for him, the follow-up of the
restorations and the development of the movable objects classified and,
more rarely, registered; this last function being reserved, except
particular case, with the conservative of antiquities and objets d'art. It
also ensures the order of the estimates, the scientific follow-up of work
and their control of work, checks the good execution and approves the
memories of it final.

Reception MISSION ANIMATION OF THE INHERITANCE:
The mission of
animation of the inheritance aims at an action of transversality within
the patrimonial services (Regional Conservation of the Historic buildings
(CRMH), Regional Service of Inventory (SRI), Regional Service of
Archaeology (SRA)) around three principal axes:
teaching activities and
training (classes of the inheritance, teacher training etc...)
dissemination of knowledge by the assistance with the publications and the
exposures carrying on the inheritance
the valorization of the inheritance
by the support of the policies of development related to the inheritance,
in particular the installation of the network Cities and Country of art
and history, the follow-up of the Poles of economy of the inheritance,
etc...
In connection with the services of cultural action, the mission has
in load the coordination of a policy of cultural tourism based on the
actions supported by the ministry.
SERVICES DEPARTEMENTAUX Of ARCHITECTURE
AND The INHERITANCE:
Recruited by a contest of State, the Architect of the
Building industries of France works within the departmental services of
architecture and the inheritance as a civil servant of State. The function
is departmental and there is at least an architect of the buildings of
France by department, installed with the chief town of department.
Its
mission is double:
to make apply the legislations to architecture, town
planning, the sites, the historic buildings and their accesses;
to direct the maintenance work on the classified buildings historic buildings when
the control of work is ensured by the ministry for the culture and the
communication or that the owners affectataires receive a financial
assistance of the State and to control work on the buildings registered
with the additional inventory of the historic buildings.
It is moreover
preserving in its department of the historic buildings belonging to the
State and assigned to the ministry for the Culture and the Communication.

WORK ON the HISTORIC BUILDINGS
Procedure of work:
In all the cases, the owner of a building protected with the title from the Code
from the Inheritance preserves the total responsibility for his
conservation.
He can be given aids granted by the State - ministry for the
Culture and the Communication - (assistances often supplemented by the
local communities, generally the department, sometimes the area).
WORK ON
BUILDINGS CLASSES:
Work on classified historic buildings is exempted
permit building; the authorization is given by the Minister for the
Culture and Transport.
Large work
They are begun on the initiative of the
owner or the administration. They are necessarily followed by the
architect as a head of the historic buildings to the title of the control
of work in the event of financial assistance of the State, or to the title
of control in the contrary case.
In the event of State aid, the procedure
is as follows: work is carried out on the basis of annual pre-programming
prepared by the Regional Conservation of the Historic buildings (C.R.M.H.)
according to the requests of the owners and the computerized medical file
of ministry (EUROSTRAT). This pre-programming takes place in spring of the
exercise preceding that in the current of which work is set up. Financial
commitments of principle of the owner are necessary. The regional manager
of the Cultural Affairs proposes then programming of work to the prefect
of Area. This programming is subjected to the approval of the Regional
Administrative Conference (C.A.R.), which gathers the prefects of
Department.
The projects of work (graphic parts and estimate) are carried
out by the architect as a head of the historic buildings and subjected to
the approval of the inspection of the historic buildings and the
Conservative of the inheritance Historic buildings of the C.R.M.H.. Any
project of work is preceded by a preliminary study of which the goal is
better to appreciate their nature and their cost. It is on the basis of
estimate of the study that the fixed price of fees is calculated.
Control
of work:
The owner can either ensure it, or to entrust it to State
(D.R.A.C. - C.R.M.H.). In the first case, the owner will receive a subsidy
which will be versed for him in proportion to the discharged invoices.
This mode of financing is governed by the decree of December 16, 1999.
Rate of financing:
The law does not fix a maximum rate at the
participation of the State. As regards investment, when the State is a
building owner, the rate generally turns around 50 % (exceptionally
with-delà).Si the owner is a building owner, the assistance will be able
to exceed 80 % of public financing only in the event of manifest urgency (decree
of December 16, 1999).
The State aid does not exclude the other
assistances of which can profit the owner (the regional Council, general
Conseil), provided that they are a local community, even private Europe or
associations and foundations:
- the foundation of the inheritance;
- Old
French houses;
- the pilgrim magazine, inter alia.
Maintenance work
strict:
This work must allow to the owners buildings classified to carry
out light interventions in order to maintain their inheritance regularly
and to avoid to the maximum resorting to the preceding procedure. The
initiative is taken by it by the owner, generally advised by the Architect
of the Building industries of France of department (A.B.F.).
The control
of work is always ensured by the A.B.F.
The control of work is ensured by
the owner to which a decree of subsidy is notified by the D.R.A.C. (C.R.M.H.).
These appropriations not being continuable one year on the other, work
must imperatively be finished before the end of the exercise. The rate of
financing of the State is generally about 50 % of the amount net of tax.
The owner will receive a subsidy which will be versed for him in
proportion to the discharged invoices.

Reception WORK ON REGISTERED BUILDINGS:
Work on the buildings registered on the
additional inventory of the historic buildings is subjected to the
legislation on the permit building with opinion of the Regional Management
of the Cultural Affairs whose time of instruction is four months to the
maximum.
The control of work of work is always ensured by the owner.
The
control of work can be entrusted to any sufficiently qualified architect
as regards restoration of the inheritance. The financial assistance of the
State is limited by the law to 40 % but it is generally located around 25
%. the criteria taken into account are the urgency, the interest of work,
the resources of the owner...
The State aid is allotted in the form of
subsidy, decided by the prefect of area, on proposal of the prefecture of
Department and the Regional Management of the Cultural Affairs and after
opinion of the regional administrative conference. After having obtained
the authorization of the permit building, the request for subsidy must be
the subject of a file to be given with the C.R.M.H..
This file includes/understands
mainly: the request for subsidy, a descriptive and estimated project of
work, graphic parts, financial commitments of the owner (deliberation of
the town council for the communes), a document of title (for the private
owners), etc...
Work is controlled by the A.B.F of the department and the
payment of the subsidy is conditioned by the signature by this civil
servant of a certificate of good completion of the work and handing-over
of the invoices. The owner will receive a subsidy which will be versed for
him in proportion to the discharged invoices.

MOVABLE OBJECTS:
Work of restoration:
A forward programme is established
by the C.R.M.H. in connection with the Conservative of the inheritance
Historic buildings and the conservatives of antiquities and objets d'art,
after agreement in principle of the owners. The control of work is exerted
either by the State or by the owner. The Conservative of the inheritance
Historic buildings ensures the control of work and order the estimates of
restoration specialized companies. The financial participation of the
State in the restoration of a classified movable object is not limited by
the law. In practice, it can go up to 50 % of the value of the the works.
With regard to the registered objects, the State can intervene financially
on a level a less (around 25 %). policy of protection against the flight
is carried out by the service, since many years.

RURAL INHERITANCE NOT PROTECTED a budgetary heading makes it
possible to subsidize work relating to buildings:
not protected with the
title from the historic buildings,
having a certain architectural quality,
possibly sheltering protected objets d'art historic buildings,
located in
rural, limiting medium of population: 2 000 inhabitants.
Nature of the
buildings concerned (public or private):
buildings cultuels or civil.
Nature of work subventionnables:
Only the subsidy object work can be
ensuring the conservation of the building: masonry, frame, cover, coated...
Subsidies:
The subsidies are approximately 20 % of the value of the the
works.
The priority criteria are as follows:
operations coming in
complement from interventions carried out on the parts protected from the
same buildings,
work of setting out of water of very threatened buildings,
work relating to buildings sheltering of the movable objects or the organ
classified.
Programming of the subsidies:
The request must be addressed to
the C.R.M.H., but only after having obtained the opinion of the architect
of the buildings of France of the department which will be able to bring
all the useful councils.
The State aid is allotted in the form of subsidy,
decided by the prefect of area, on proposal of the prefecture of
Department and the Regional Management of the Cultural Affairs and after
opinion of the regional administrative conference. Moreover, it is
necessary to announce the existence in the Limousin of a contract of plan
between the State and the Area. The restoration of the small inheritance
not protected can receive a State aid or Area according to quite
particular methods' until 2006.

BUILDING
SITES OF YOUNG BENEVOLES
Born after the First World War in a spirit of
reconciliation and of international bringing together, the building sites
the voluntary ones mainly developed since about fifty years starting from
the associative medium.
They relate to various fields, such as the
architectural heritage, the environment and the equipment socioeducational,
sporting or social.
Organized each year with the assistance of the
Management of the Inheritance to the Ministry for the Culture and the
Communication and the services of the Ministry for Youth and the Sports,
they gather in France more than 10 000 people, of which handicapped people
and young people of underprivileged mediums.
Financial assistance: The
Ministry for the Culture and the Communication intervenes financially for
the building sites concerning the monumental inheritance protected with
the title of the law from 1913 on the Historic buildings having been the
object from a measurement from classification or one inscription to the
additional Inventory from the Historic buildings. Its assistances relate
to the purchase or the lease of the materials and materials of building
site and construction, finançables as an indication, with height of 20 %
for work on a monument registered and of 50 % on a listed monument. The
decision of attribution is done jointly with the services of Youth and the
Sports, which intervenes as for it, on the cost of operation of the
building site. The amount of the assistance is calculated on the estimated
estimates presented at this occasion, and from which the documents in
proof are exigible on invoice with the exit from work. Other assistances
can appear in the title of the estimated budgets, in particular of the
local communities, in complement of the participation of the voluntary
ones.
Control of work:
This work is carried out for the account of a
building owner, which is either the owner (public or private) of the
building, or the person or entity while having received delegation by the
owner, who can then be intervening association; this one also generally
ensures the control of work, implying the direction and the control of
work and the markets. The law of 1913 envisages, for work carrying on a
historic building, that the project superintendent must have a sufficient
qualification, to even be itself qualified architect or architect named
after contest by the Minister in charge with the Culture and the
Communication.
This office plurality of functions implies many obligations
on behalf of association, at the same time as its tasks of executant, of
which it is advised to him to take note near the services of the Ministry
for the Culture and the Communication at the regional level and the
departmental services of architecture.
Intervention relating on the
basement or an archeological site:
In the same way, no intervention
relating on the basement or an archeological site, will have to be done
without requiring of it the authorization near the Regional Service of
Archaeology. Its opinion will be always necessary (including on sites not
protected with the title from the Historic buildings) for work considered
and a person in charge could be designated by this service to carry out a
follow-up of work.
In the same way, the opinion given by the Regional
Conservation of the Historic buildings, the Architect of the buildings of
France like that of the Regional Service of Archaeology, will be able to
condition the effective payment of the subsidy or the authorization of

Hygiene and Safety:
Lastly, one could not insist too
much on the conditions of hygiene and safety in which the building sites
the voluntary ones must function. The law imposes for this purpose a
double obligation of insurance to the building owners and the speakers to
cover the whole of the responsibilities weighing on the latter, without it
being made obligation of permit building or declaration of work. Moreover
the general inspection of the Administration of the Cultural Affairs
reserves the right to pay checks on the building sites to check of it the
conformity of the provisions of hygiene and safety, with all the
consequences that that can imply as for the continuation of work.
All these provisions can appear constraining compared to the passion whose
make proof the voluntary young people; one however should see there only
one whole of measures intended to bring to them on the ground the safety
which they deserve, as to prevent any damage that an unwise enthusiasm
could bring to sites of a great patrimonial interest.
The Councils:
It is
thus highly advised with associations launching out in a program of
building site the voluntary ones to adhere to the one great unions or
national federations whose list will be communicated to them by the
services of the ministries for the Culture and the Communication, Youth
and the Sports, the Solidarity and Employment or Environment and Regional
planning, and whose competence is guarantor of the respect of the
legislation in this field.
It is only in these conditions which the young
people will find there most favourable the framework with the perpetuation
of the values that they seek in these building sites, of meeting and
solidarity for concluded of collective projects of an excellent teaching
value.

In a preoccupation of simplification
and a harmonization of the procedures, there is from now on a single file
of request for subsidy intended for associations (circular of the Prime
Minister for December 24, 2002 relating to the State grants to
